Participant Waiver, Assumption of Risk & Release of Liability

Event: Cape Town Relay Project - open-route relay around the Cape of Good Hope on public roads and paths.
Organizer: anomalie GmbH, its offices, employees, contractors, volunteers, partners, sponsors, venue owners, and agents (”Organizer”)
Participant: The undersigned athlete, support driver(s), and team members (”Participant”)
By registering, I agree to the following terms for myself and (if applicable) for the team members I registered or will register:
- Eligibility & Conduct
- I am 18+, medically fit, and able to participate.
- I will follow all event rules, briefings, and marshal instructions.
- This is an open-route event (not a closed course). I must obey all traffic and local laws at all times.
- Outside support beyond our 5-person team is not allowed. You may bring one optional driver. Personal media may attend as observers only (no pacing, navigation, or aid).
- I will act respectfully toward communities along the route and other road users.
- Safety Requirements
- Certain segments may have elevated risk. Where flagged by the Organizer, the support car must shadow the active runner; no solo running in these zones.
- Night/low-light mandatory kit: reflective vest, headlamp, rear red light, and a charged mobile phone.
- The team carries a basic first-aid kit, hydration, and nutrition for the runners.
- The runner must wear the event GPS tracker at all times while active.
- Vehicles: Road-legal, insured, driven by a licensed, sober driver; no texting while driving, park only where legal and safe; do not “pace” the runner with hazards on for extended periods.
- Follow all traffic, municipal, and park rules; yield to emergency services and other road users.
- No participation under the influence of alcohol, drugs, or impairing medication.
- Assumption of RiskI understand endurance running on open routes involves inherent risks, including traffic, surface hazards, weather, darkness, crime or third-party acts, animals, dehydration, overexertion, equipment failure, limited immediate medical support, and actions of teammates or other participants. I voluntarily assume all such risks, known and unknown.
- Release of LiabilityTo the fullest extent permitted by law, I waive, release, and discharge the Organizer from any claims, losses, damages, or liability (including injury, illness, or death) arising from my participation, except where caused by the Organizer’s gross negligence or willful misconduct.
- IndemnificationI will indemnify and hold harmless the Organizer from any claims, costs, damages, and legal fees arising from (a) my actions, (b) actions of my team, drivers, or personal media, or (c) our vehicles / equipment.
- Medical Fitness & Treatment
- I am medically fit and not competing against medical advice.
- I will disclose relevant conditions to my team and carry needed medication.
- I consent to first aid and emergency medical treatment.
- Medical, evacuation, and transport costs are my responsibility; I am advised to carry suitable health / travel insurance.
- Route, Timing & Rules
- Teams must check in at required checkpoints; missed checks or rule breaches may mean penalties or DQ.
- The Organizer may impose cut-offs, reroute, delay, or cancel for safety, weather, or operational reasons (force majeure).
- All final rule interpretations rest with the Organizer.
- Fees, Transfers, Refunds
- Entry fees are per team and generally non-refundable / non-transferable, except as required by low or per the posted policy.
- Any approved substitutions must meet eligibility and be confirmed before race day.
- Media & Likeness
- I grant the Organizer a royalty-free, worldwide license to use my name, image, and voice from the event for coverage and promotion.
- Personal media crews are observers only - as mentioned above. They must follow Organizer instructions.
- GPS Tracking & Data
- I consent to live GPS tracking for safety and the event experience.
- I consent to the use of my personal data for registration, safety, timing, results, and communications per the Organizer’s privacy notice.
- Equipment and PropertyI am responsible for my own equipment and belongings. The Organizer is not liable for loss, theft, or damage.
- Code of Conduct and our Environmental Responsibility
- Treat local communities, other participants, and road users with respect; no harassment or abuse.
- No littering; leave no trace and respect wildlife and protected areas.
- Comply with all lawful instructions from police, officials, and marshals.
- Severability, Governing Law & VenueIf any term is unenforceable, the rest remains in effect. This agreement is goverened by the laws of the Republic of South Africa; venue is Cape Town courts unless the Organizer specifies another lawful forum.
- Acknowledgement & E-SignatureI have read and understood this agreement. I am signing freely and voluntarily, knowing I am waiving legal rights by doing so.
